Purchase agreements on the webshop are in English.
These terms and conditions apply when you purchase goods on the website. The terms and conditions may be updated from time to time (for example to reflect changes in technology model, or in relevant laws and regulations), and we therefore ask you to accept the terms and conditions pop-up when you shop with us. Any reference to "you" or "your" means you as a user of the website, any reference to "we", "us" or "our" means NAGA A/S. If you do not accept our terms and conditions, you cannot order or make a purchase on naga.dk.
We accept payment with Visa, MasterCard, Visa electron and Maestro. We do not charge card fees on cards issued to private individuals. The amount will only be deducted when the item is shipped. Once your goods leave our store, your payment will be debited.
If you have ordered multiple items and one of the goods is backordered, we will only deduct the payment for this item, once the item is shipped.
The prices are stated in Euro and include 25% Danish VAT.
We only deliver to addresses in the following countries:

SHIPPING AND DELIVERY TIME
After you confirm your order, you will automatically receive a receipt by e-mail. We'll process your order as soon as possible. All orders are packed and send within 3-5 working days. An order placed on a public holiday or during the weekend will be processed on the following working day.
All customers paying by card are subject to validation checks, and NAGA A/S reserves the right to delay any order if we believe that additional safeguards are necessary. Once your package is shipped, we will send you an e-mail with a shipping number on the package.
To the following countries:
For Austria, Belgium, the Czech Republic, Germany, the Netherlands, Poland and Sweden, the price is EUR 10.
To other countries:
Bulgaria, Croatia, Cyprus, Latvia, Lithuania, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Luxembourg, Malta, Portugal, Spain, Romania and the Slovak republic will be priced according to shipping at check-out in the shop.
Boards 80 cm and larger cannot be delivered outside Denmark.
Goods will be delivered to the delivery address specified in the order. Please note that the risk of loss of or damage to the goods passes to you after delivery. If the package appears to be damaged, you should refuse to receive the goods, or receive it with reservations. RIGHT OF CANCELLATION AND RETURN
If you wish to cancel your purchase, you are entitled to do so, without justification, within 14 days.
The cancellation period expires 14 days after the day on which you have physical possession of the goods.
If you have ordered multiple items in one order and we cannot deliver the goods at the same time, the cancellation period starts from the time you have the last item in your physical possession.

The cancellation deadline is complied with if you send your notice that you want to cancel the purchase before the cancellation period has expired.
You cannot cancel by simply refusing to accept the goods or by failing to retrieve them without, at the same time, informing us of your decision to cancel. The return shipping fee will be deducted from the amount you will receive in return.
If you want to cancel the purchase of a product, you are responsible for its return to our warehouse in full condition. You must send or return the item to:
We must receive the goods within 14 days after you have informed us that you wish to cancel your purchase. Goods cannot be returned as payment upon delivery or non-delivery. You will have to pay shipping and any other expenses associated with the return. When returning an item, you are responsible for ensuring that the goods are packaged properly, as you have the risk for the goods from the time of delivery until we have the goods returned.
We recommend that you use Track and Trace so you can follow the package at all times, remember to save the shipping receipt.
Be aware that there may be a price difference depending on which carrier you choose to use. You can obtain an offer for the return of your goods by contacting a transport company.
We will reimburse the amount without undue delay once we have received the goods back. We will carry out the refund using the same means of payment as you used for the original transaction, less any shipping charges, but without fees, which result from the reimbursement.
You are only liable for any deterioration of the value of the goods due to other handling of the goods than is necessary to determine the nature of the goods, the characteristics and the manner in which they operate as would be done in a physical store. If you have removed the tags, or treated the product in such a way that we cannot sell it again, or cannot sell it at full price again, please be aware that we will deduct the depreciation. If the item no longer has a commercial value, we will not refund the purchase amount. The lack of original packaging may constitute an impairment, so in order to be sure of receiving the money back, it is recommended that the goods be returned in their original packaging.
Making a claim
If you purchase a product with a flaw, for example, a defect or manufacturing defect.
You can claim defects in the item within 24 months from the time of delivery, however, you must always make the claim within "a reasonable amount of time" after you have discovered the defect. We recommend you make the claim as soon as possible, and within two months of discovering the deficiency.

Do not return goods without first contacting us. In many cases, it is not necessary to return the item as long as we receive a picture of the defect. Claims must be made in writing, since we cannot see the error through the phone. Please write in your e-mail if you want a replacement of the product or a reduction in price, if your claim is justified.
If you return the goods, which end up not being eligible for a claim, you must bear the shipping costs yourself.

LAW AND JURISDICTION
Purchases on the webshop are covered by Danish law and jurisdiction by the Copenhagen City Court. However, mandatory national legislation may be applied to delivery outside Denmark. Persons under the age of 18 cannot shop on this webshop without the consent of a guardian.
NAGA A/S may change the content of this website at any time. NAGA A/S cannot be held liable for any damages arising as a result of the use of the site, or for that matter, a lack of access to the website.
We take precautions regarding price changes, key errors and sold-out items.
Force Majeure, we are not responsible for delays or failure to meet our obligations in relation to the Terms, if the delay or the non-compliance is due to events beyond our control.
NAGA’S PERSONAL DATA POLICY
We treat your personal data confidentially.
We only collect personal data in cases where this should be relevant to us, and we will only collect personal data if it is relevant to your activity at NAGA A/S. When collecting, processing and using your personal data, we always comply with all relevant legal provisions. We will only store your personal data as long as we are legally obliged to do so, or as long as it is relevant to the purpose for which the data was collected.

The data controller

Basis of treatment and purpose
We collect your general contact information such as name, address and telephone number in order to deliver the product that you have purchased from us. We will collect your e-mail address in order to send you an order confirmation and a delivery confirmation.
When you pay for your product, we collect your name, card data and IP address. The information collected in connection with the payment transaction is used and stored only for payment settlement and fulfillment of the agreement.
If you have given us your consent during the registration process or on a sign-up form on our website, we will use your e-mail address to send out a newsletter.
You can sign up for and unsubscribe from the newsletter at any time. All newsletters also contain a link to unsubscribe. If the processing of personal data is based on your consent, you have the right to revoke the consent at any time.
If you do not want to provide the personal data required to complete a purchase of a product, you will unfortunately not be able to purchase products on our website.
Your information (except your email address if you have consented to its processing for the purpose of receiving offers) will be deleted automatically 5 years after you have received your goods.
Other recipients of personal information
NAGA A/S uses Google Analytics to generate statistics on the use of naga.dk. NAGA A/S cannot access your IP address, but it is used by our partner Google Analytics, which processes this to generate general statistics about users and the use of our website.

NAGA A/S uses Facebook Pixel on naga.dk to collect data for use in targeting and optimizing our Facebook ads. Facebook Pixel receives information about your device, the ads you see and the way you use naga.dk. Facebook Inc. uses personal information collected via Facebook Pixels to improve their advertising system. In connection with the delivery of goods that you have purchased from NAGA A/S, information about your name, address, e-mail, telephone number and order number and specific delivery requests will be passed on to the carrier who is responsible for the delivery of the goods.
Credit card information is encrypted and cannot be read by anyone, neither us or any third party.
Payment is made via ePay (Bambora), where the following is stated; Card no., Expiration date, CVV / CVD - We point out that ePay (Bambora) is a data processor (payment gateway).
The information is stored in a secure PCI certified environment, which complies with international security standards (Payment Card Industry - Data Security Standard). When you use a payment card on naga.dk, only ePay (Bambora) - and not NAGA A/S - will have access to your information.
Relevant information can be transferred to external partners who process the information on our behalf. We use external partners for, among other things, technical operation of systems and improvements of naga.dk. This may be in connection with the distribution of newsletters as well as targeted marketing, including remarketing and for the assessment of our company.
Data processor agreements have been made with these companies and they trade under our instructions, and process data for which we are data responsible. The data processors do not use the information for any purpose other than fulfilling the agreement with us, and they are subject to confidentiality about this. We have entered into written data processor agreements with all data processors that process personal data on our behalf.

Some of these data processors, e.g. Google and Facebook are established outside the EU. The necessary guarantees for the transfer of information to the United States are secured through the certification of the data processor under the EU-U.S. Privacy Shield, cf.
